Wii doesn't fully turn off + System Menu doesn't work

Ok, so my wii has been a whore since the start and I can't turn it off, even prior to trying to install the softmod. When I press the power on the controller or the console, it will turn the display off but the light remains green. I then can not try to turn it back "on". I must unplug and then replug it in for me to be able to turn it on.

I'm also having problems with the system menu. I tried to install preloader and got an exception, which I then went to try to re-install it it and it said it was already installed and then proceeded to reboot. When it did, I was in the preloader menu, fixed the options, blah blah...and now I can no longer load my system menu. I'm pretty sure it's not a big deal as I believe I can just reinstall the system menu through wad manager...but how do I know which system menu to install. I was following the 3.1-4.1 tutorial (or w/e versions it is) and at the end it mentioned this problem but then never said how to pick which system menu you have. This is the download directory I'm looking at.

So if I can get help with these 2 problems, I would greatly appreciate it! Especially the first issue as it effing annoys the living shit out of me and I'm thinking about just returning the POS because of it.

    TL;DR
    1. Wii doesn't turn off with power button on console or controller
    2. System menu is effed up and can't load it, what do I do?

    Thanks,

    Azzid

Yea the power issue is enough to know something is wrong with it and should probably be returned if possible.

What's the safest way to get it back to running the system menu so I can return it without a problem?

Yes, I ran the firmware upgrader to 4.1. So I'm on 4.1U I believe, I just don't know which of those files to download. I figured System menu-NTSC-U-v417.rar was the one...but I want to be 100% sure.
