Game problem?

i bought this game resident evil 5 just today ,,the problem is it doesnt load in the menu,,so i click on it and a screen pops out saying
" initiating a wii system update"

and it continues if i want the upgrade or not and says...
"..........if your wii console has an authorized technical modification this upgrade my cause inoperability to your console."
i just decline the upgrade.All other games work except this one!
And its just this one that pops up and ask me if i want to update!

could it be that the game dvd only plays on a certain version?
My wii is on version 3.1U
Ive already softmod it .

how do i go about playing and fixing this problem with this game?
