    Things got even more bleak for Crippen and his defense team last week when the judge ruled they could not use the "fair use" defense. Crippen's attorneys had hoped to argue that installing a mod chip in a gaming console was no different than jailbreaking an iPhone to allow owners to use software not approved by Apple. iPhone jailbreaking was OKed under a DMCA exception approved by the U.S. Copyright Office.
    Fair use, interesting. I wonder who determined that Microsoft products are covered by DMCA and Apple products are not?

    I wonder how many he modded total? Logic would dictate Fair Use would fly out the window at some point...Especially seeing as how he was doing it for profit. At least it seams like they got the right judge for the case. It will be interesting to see how this one plays out.

    It has to be a fairly high number since the he was having agents watch him do it. Or he must of been advertising a lot such as on craigslist and on flyers. I wonder if just people that buy modchips could also be a target too?

    That is a very interesting question Stomp. Seems to me that what is good for one, should be good for all.

    "IF" they wanted to, the Feds could raid chip dealers, mod shop owners, etc...I remember years ago they (Feds) did that to the satellite hackers. They busted everyone, buyers and sellers of hardware, cards, etc.

    Case dismissed due to procedural issues, the judge admonished the prosecution for a poorly laid & executed case. Also, the prosecution claimed that the modder had put in a pirated disc to prove his mod worked & convieniently did not get that part on video. Unless they could have proven he was pirating games, i don't think the government would have won the case anyway.

    Are they for real

    This is stupid cause if you pay $400 dallors for a system and all the countless money for the accessories.you should be able to do any you want to your system.don't hate on the hacker for haveing the knowledge to do it.to come to think of we pay enough money into these corp.it not he's hacking goverment files (really).
