Yeah, when I try to set it to IOS38 (REV3610) I get a 1oct1 error (DI_readID). I even enabled the "use selected IOS." Is there another IOS38 update that I need instead of REV3610? And if so do you know if it will effect rockband and guitar hero from being able to work with the USB?

Yeah I can set the IOS to 249 (rev14) but still no sound. When you load it using IOS 38 does it actually say (rev 14) right after the 38... where mines says (rev3610)?
i couldnt update my CIOS 38 rev 14 to ISO38 it gave me INSTALL ERROR (ret = 2011) i had to add it to custom 249, so i cant load it using 38 i get that same error you get. weird how it works on some Wiis and not others. i wonder if you reinstall your CIOS 38 rev 14 to 249 then launch the game from softchip99 using the 249 ISO i have no idea what my 38 rev actually is, sorry.

got bored and updated to 4.1 firmware even...and there was still no sound.
did some more digging and I noticed someone mentioning that this is a multi5 disc not English, which wasn't mentioned anywhere in the release...but it never asks you which language to select...so I thought maybe it might be causing this problem, not knowing which language audio track to load up?
so went into softchip99 settings again and changed it from Auto Force Language to System Default (honestly I don't know if it was always set like that or if I accidentally switched it over while trying to get it to work before) but anyway...sound works now! so give this a try I guess. and thanks for the other tips.
