Playing a backup is perfectly fine. Cheating is not. Some games if you play them out of region would connect you to an improper server (Monster Hunter Tri is such an example, from memory) and give issue. This isn't XBox 360, this is Nintendo.

I got monster hunter 3 retail physical copy. If i make a digital backup on my hardrive to load on loader GX, will nintendo discover that i have made it a backup and then ban me? Or can i only get banned if i use cheats?
Nintendo won't be able to know if the game running is from disk or USB. My kid plays MW3 all the time from USB.
As for cheats, I'm not sure. We frown upon the use of cheats in multi-player games. Other than that official stance, I've never used them.
