I'm sure Nintendo could determine if you loaded WiiWare/VC game that was not purchased, but currently they have not banned or bricked anyone's Wii because of it. In the 3.3 update, they tried to stop people from loading the TP hack but a new way was discovered to load the TP Hack. But in the Future no one knows what Nintendo will do.
