no updating to 4.3 is epic fail
A game running doesnt = system menu upgrade

What cios have you got installed

No! Don't update to 4.3. games are not dependent on the system menu version. Only IOS/cIOS depending on how you load the game.
    Damn I suck!!!!

as I said run a sys check

or you can just do this guide from chapter 2 http://www.wiihacks.com/recommended-...d-any-wii.html

This will bring your properly up to date and take you down to 4.1 if you wish

I have done some searching, and I haven't found any reports about it needing an updated IOS to run, but that doesn't really mean anything since it is new. If you are really anxious to try it, you could enable Priiloader hacks to block disc updates (go ahead and block online updates too), then run the game and hope it doesn't crash.

If you don't use the disc, you shouldn't need to update any official IOS's. Your cIOS's are probably fine if it has only been a few months, but go ahead and post a system check.

Install cIOS38 Rev 17. Load your games with IOS222/223/249. Try all of them, come back if no luck.

Looks like you didn't follow a guide here...
