also think this way, nintendo doesn't have the time (the probably have the resorcest but) to check every single wii in the world. just dont go overboard and dont hack on the net.

I don't think they are banning people with the Homebrew channel it's just the sad lot who have to gain an unfare advantage.
If you do get banned I think it would be your IP address or your MAC code that they would use to block you. More the MAC code as that stays the same where as IP address change (dynamic) unless you have a static one.
so re-formating the wii would not work.
