A few questions before I go to far with this

I have a couple of question for those of you who are currently using the home brew or the drive key modchip. I have heard by reading a few different threads in different web searches I have done that the wii support code 41212 has stopped the ability to use home brew or mod chips first off is this true? I have not did updated to the wii support code 41212 yet and have noticed there is a disclusure you have to agree to before you down load it that says:
IMPORTANT: If you do not want to accept this upgrade you can shot down your wii console and cancle the upgrade by holding down the power buttom for 4 seconds. If your wii console has an unauthorized technical modification this upgrade could cause inoperability of your console.
So assuming that the home brew and modchips still work after this wii update do I need to do anything different than what is already listed in this forum under heading of home brew? What I am really trying to accomplish is be able to down load the orig nes games Zelda, dragon warrior, and final fantasy. I know that can be done with home brew, not sure if it can be done with mod chip though. Can it be done with a mod chip? Also I would like to be able to play online with my Wii with out getting in trouble from nintendo for using either modded or burned games is this even possible?

Updating to 4.0 will not effect the modchips. You should have HBC with your Cios modifications BEFORE you do your update or you will not be able to install HBC. After the install of the upgrade... install cios36 rev9.
As far as the Warning.....it is on every upgrade. This question has been asked and answered thousands of times.
Your question on the chip abilities..... a chip will make the wii believe it is running an original disk when it is actually running a 1:1 copy (aka Back-up). If configured it will force region free operation and also block updates. It does not run emulations.
